TABLE OF CONTENTS

Thank you for using I Know It. I Know It strives to address and comply with privacy best practices and regulations, including as laid out under the Family Educational Rights and Privacy Act (FERPA), Children's Online Privacy Protection Act (COPPA), Student Online Personal Protection Act (SOPPA), New York State 2-d Education Law, and California Consumer Privacy Act (CCPA), if and where they apply, along with any and all applicable law. In that spirit, I Know It does not sell any information it collects and I Know It encourages and/or requires all parties it interacts with to use best practices or follow applicable regulations. I Know It and its affiliates TPW Inc., TPW Websites LLC and Super Teacher Worksheets, (hereinafter referred to as "I Know It," "us," "we," "our," or "Company") has created this website privacy policy ("Policy") to apply to all users and customers of this website and all digital assets contained or offered therein (collectively, our "Services"). This Policy describes, among other things, the types of information we collect about you when you visit and use our Services, how we use it, and how you can access your information. By accessing the Services and providing your personal Information (as described in Section II, below), you acknowledge that you have read and understand this Policy and consent to the Information collection and handling practices set forth in this Policy.

This Policy is integrated into our Terms of Service ("Terms of Service"). If there are inconsistencies between our Privacy Policy and the Terms of Service, the Privacy Policy controls.

I Know It offers an interactive math platform for elementary students as part of the Services. The Services may be used by schools and related entities, organizations, and administrators that sign up to use the Services, including teachers who access the Services on the school's behalf (each a "School") or by parents. We currently offer the following types of accounts on our Services: School District Accounts (which are only for educational institutions), Teacher Accounts, and Family Accounts.

A. School District Accounts

School District Accounts are accounts for an entire school or school district. A school district account will have School Administrator Accounts, who work in conjunction with the I Know It team to set up these accounts before setting up specific accounts to meet the needs of the school or school district.

B. Teacher Accounts

Individual classroom teachers set up and administer Teacher Accounts and assign the usernames and passwords to students within the Teacher's classroom, by creating Family Accounts for students and their parents or guardians to use. Each of these accounts will have a separate username and password, and each student and his or her parent(s)/guardian(s) will use the same username and password.

C. Family Accounts

A Family Account is an account for a parent or guardian to administer for their child or children. Parent(s) or/guardian(s) set up and administer the accounts when not under the umbrella of a Teacher Account. The parent or guardian and student then share the same username and password.

D. Student Data

Through the course of providing the Services to a School through a School/District or Teacher Account, we may have access to Student Data that is provided by the School, by the parent or guardian, or by the student. Student Data means personally identifiable information as that term is defined by the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g) and its implementing regulations (34 CFR Part 99). We have access to Student Data only as requested by the School. The type of Student Data we collect will depend on how the School uses the Services. In some instances, the Schools may allow students to log into the Services. In that instance, the School provides each student with login credentials and confirms that it has obtained appropriate parental consents, as needed, before the student is permitted to access the Services. We consider Student Data to be confidential and do not use such data for any purpose other than to provide the services on the School's behalf. Our collection, use, and disclosure of Student Data is governed by our Terms of Service, the Children's Online Privacy Protection Act (COPPA), and applicable state laws which relate to the collection of Student Data. If you are a student or parent, please contact your School if you have questions about the School's use of technology service providers like I Know It.

We may collect the following types of information about you which are described in more detail below: (A) information you provide to us, (B) information we may automatically collect, and (C) information we may receive from third parties. All of the information listed in (A)-(C) above, is detailed below, and hereinafter referred to as "Information." Please note that you do not need to tell us who you are or offer any personal Information in order to view our Services. The Information we collect and the purposes for which we use it will depend to some extent on the specific Services you use, the type of account you have, and how you interact with I Know It. Some of the Information we collect may constitute "personal information" under applicable data privacy laws.

A. Information You Provide to Us

In using our Services, you may provide us with Information in a variety of ways, including, without limitation the following:

  • Student's name;
  • Parent's email address;
  • Student's grade level and teacher name;
  • Unique identifiers such as username and password used to access your account;
  • Payment and transaction information including credit or bank card information collected from the purchase of Family Account on the Services; and/or
  • Additional Information as otherwise described to you at the point of collection or pursuant to your consent.
B. Information We May Automatically Collect About You

Our Services may automatically collect certain Information about you. We use this Information to help us design our Services to better suit our users' needs. This Information may include:

  • IP address, which is the number associated with the service through which you access the Internet, like your ISP (Internet service provider);
  • Date and time of your visit or use of our Services;
  • Domain server from which you are using our Services;
  • Type of computer, web browsers, search engine used, operating system, or platform you use;
  • Data identifying the web pages you visited prior to and after visiting our website or use of our Services;
  • Your movement and activity within the website, which is aggregated with other information;
  • Mobile device information, including the type of device you use, operating system version, and the device identifier (or "UDID")
C. Cookies & Technologies Used to Collect Information About You

We collect the above Information directly and through the use of third parties. We collect this Information by using certain technologies, such as cookies, web beacons, and other technologies. Third-party service providers, advertisers, and/or partners may also view, edit, or set their own cookies or place web beacons. The use of these technologies by such third parties is subject to their own privacy policies and is not covered by this Policy, except as required by law.

1.a. Cookies (or browser cookies). We use cookies to increase the functionality and ease of use with our Services. A cookie is a piece of data stored on your hard drive that contains information about your computer and Internet use. To enhance your experience, cookies may be used to track and target your interests. You can always choose to not accept cookies. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our website. If you choose not to accept cookies, you may still browse our Services, however you will be unable to order or have access to all our Services.

1.b. Web Beacons. Website pages may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity). We also use these technical methods to analyze traffic patterns, such as the frequency with which our users visit various parts of the Services. These technical methods may involve the transmission of Information either directly to us or to a third party authorized by us to collect Information on our behalf. Our Services use retargeting pixels from Google, Facebook and other ad networks. We also use web beacons in HTML emails that we send to determine whether the recipients have opened those emails and/or clicked on links in those emails.

1.c. Mobile Device Identifiers. Certain mobile service providers uniquely identify mobile devices and we, our partners or our third-party service providers with whom we contract may receive such device information if you access the website through a mobile device. Additionally, some mobile service providers operate systems that pinpoint the physical location of devices that use their services. Depending on the provider, we or our third-party service providers may receive this Information.

1.d. Embedded Scripts. An embedded script is programming code designed to collect Information about your use of the website included in our Services, such as the links you click on. The code is temporarily downloaded to your computer from our web server or a third-party provider, is active only while you are connected to the website and is deactivated or deleted once you leave the website.

1.e. Analytics. We use tools such as Google Analytics, a web analytics tool provided by Google that helps websites and online services collect and analyze information about how visitors use and interact with their sites and services, and based on information collected and analyzed through Google Analytics websites and online services can measure the performance of and make improvements to their sites and services. Google Analytics uses first-party cookies to track visitor interactions on our website and to collect information about how visitors use the website. We use the information collected through Google Analytics to help us understand the demographics, usage patterns and interests, trends, etc. about visitors to the website. Google Analytics collects and reports usage information anonymously without identifying any particular visitor individually. Google's ability to use and share information collected by Google Analytics about your visits to the website is subject to the Google Analytics Terms of Use published at http://www.google.com/analytics/terms/us.html and the Google Privacy Policy published at http://www.google.com/intl/en/policies/privacy/. Disabling cookies on your browser may be able to prevent Google Analytics from recognizing you on return visits to the website. Google also offers a browser add-on for users to install to opt out.

1.f. Notice Concerning Do Not Track. Do Not Track ("DNT") is a privacy preference that users can set in certain web browsers. We are committed to providing you with meaningful choices about the Information collected on our website for online advertising and analytics purposes, and that is why we provide the variety of opt-out mechanisms listed above. However, we do not currently recognize or respond to browser-initiated DNT signals.

D. Information We May Receive from Third Parties

We may collect additional Information about you from third-party websites, social media platforms, such as, but not limited, to Facebook, Twitter, Instagram, and Pinterest ("Social Media Platforms") in accordance with your privacy settings on those platforms, and/or sources providing publicly-available information (e.g., from the U.S. postal service) to help us provide services to you, help prevent fraud, and for marketing and advertising purposes.

Information we may access about you, with your consent, may include, but is not limited to, your basic Social Media Platform information, your location data, your list of contacts, friends or followers and certain information about your activities on the Social Media Platform. Please keep in mind that when you provide Information to us on a third-party website, the Information you provide may be separately collected by the third-party website or the Social Media Platform.

A. Use and Purpose of Processing Your Information

We use and process your Information for things that may include, but are not limited to, the following:

  • To provide the Services, related products and information you request;
  • To process the type of account that is opened;
  • To measure student performance in activities and to help adapt a student's learning experience to the student's learning needs;
  • To confirm your eligibility or correspond with you regarding a contest, promotion, sweepstake or service including notifying you of the results;
  • To analyze, provide progress reports on, or provide an assessment of a student's performance to the teacher or parent/legal guardian on the account;
  • To respond to your inquiries and provide you with requested information;
  • To provide you promotional material or special offers on our behalf, provided that you have not already opted-out of receiving such communications;
  • To fulfill contracts we have with you;
  • To manage, improve and foster relationships with third-party service providers, including vendors, suppliers, and parents, affiliates, subsidiaries, and business partners while providing the Services;
  • To maintain, improve, customize, or administer the Services, perform business analyses, or other internal purposes to improve the quality of our business, the Services, resolve technical problems, or improve security or develop other products and services;
  • To improve the educational content offered on our Services and resolve any technical problems;
  • To analyze the use of the Services and Information about visitors to our website to understand and improve our offerings;
  • To customize the content you see when you visit the website, including to develop and provide advertising tailored to your interests;
  • To comply with our Terms of Service;
  • For analytics for business purposes and business intelligence;
  • To comply with any applicable laws and regulations and respond to lawful requests, including applicable state education laws; and/or
  • For any other purposes disclosed to you at the time we collect your Information and/or pursuant to your consent.
B. Sharing Your Information

We may share your Information as set forth in this Policy in the following circumstances:

  • Third-Party Service Providers. We may share your Information with third-party service providers that perform certain functions or services on our behalf (such as to host the Services, fulfill orders, provide products and services, manage databases, perform analyses, process credit card payments, provide customer service, or send communications for us ). These third-party service providers are authorized to use your Information only as necessary to provide these services to us. In some instances, we may aggregate Information we collect so third parties do not have access to your particular Information to identify you individually.
  • Disclosure of Information for Legal and Administrative Reasons. We may disclose your Information without notice: (i) when required by law or to comply with a court order, subpoena, search warrant, or other legal process; (ii) to cooperate or undertake an internal or external investigation or audit; (iii) to comply with legal, regulatory or administrative requirements of governmental authorities (including, without limitation, requests from the governmental agency authorities to view your Information); (iv) to protect and defend the rights, property or safety of us, our subsidiaries and affiliates and any of their officers, directors, employees, attorneys, agents, contractors and partners, and the website Service users; (v) to enforce or apply our Terms of Service; and (vi) to verify the identity of the user of our Services.
  • Business Transfers. Your Information may be transferred or otherwise conveyed ("Conveyed") to a third party where we: (i) merge with or are acquired by another business entity; (ii) sell all or substantially all of our assets; (iii) are adjudicated bankrupt; or (iv) are liquidated or otherwise reorganize. You agree to any and all such Conveyances of your Information.
  • Educational Institution Affiliation. We may facilitate the sharing and disclosure of Student Data with third parties and other users designed by the educational institution when instructed and authorized to do so on behalf of a School. We do not sell Student Data or use or disclose it for any marketing or commercial purpose, in accordance with applicable state education laws.
  • Online Communications. I Know It may periodically send surveys account holders about their opinion of current Services or of potential new services that may be offered. Users may also submit comments through our I Know It Blog as well as enter monthly contests that we periodically run through our Services. If you choose to submit such information to us, the information that you submit may be available generally to the public and will not be returned to you unless we receive such a request. Information that you provide in these areas may be read, collected, and used by others who access them.
  • With Your Consent. We may share Information consistent with this Policy with your consent.

Except as provided in this Policy, we will not sell, trade, or disclose your Information we have collected without your consent.

We may aggregate and/or de-identify any Information collected through the Services so that such Information can no longer be linked to you or your device ("Aggregate/De-Identified Information"). We may use Aggregate/De-Identified Information for any purpose, including without limitation for research and marketing purposes, and may also share such data with any third parties, including advertisers, promotional partners, and sponsors, in our discretion.

Our Services may contain links to other websites or services that are not owned or controlled by us, including links to Social Media Platforms such as Facebook, Instagram, Twitter and Pinterest, or may redirect you off our website away from our Services to other websites for information, other services, or to receive special offers. These other websites may send their own cookies to you, independently collect data or solicit personal Information and may or may not have their own published privacy policies. If you visit a website that is linked to our Services, you should consult that website's privacy policy before providing any Information.

This Policy only applies to Information collected by our Services. We are not responsible for the privacy and security practices of those other websites or Social Media Platforms or the Information they may collect (which may include IP address). You should contact such third parties directly to determine their respective privacy policies. Links to any other websites or content do not constitute or imply an endorsement or recommendation by us of the linked website, Social Media Platform, and/or content.

We use commercially reasonable measures to provide our Services. We are committed to maintaining the security and confidentiality of student Information, including, but not limited to, any Student Data, which we receive through School/District or Teacher Accounts. Some of the precautions we take include (a) limiting employee access to student Information to only those employees with a need to such access to fulfill their job responsibilities; (b) conducting background checks on our employees and, specifically, upon all employees that may have access to Student Data; (c) requiring employees to sign confidentiality agreements upon hiring; (d) conducting regular employee privacy and data security training and education; and (e) protecting Information with commercially reasonable technical, contractual, administrative, and physical security safeguards.

Please be aware, however, that no information system can be guaranteed to be 100% secure, so we cannot guarantee the absolute security of your Information. Moreover, we are not responsible for the security of Information you transmit to the Services over networks that we do not control, including the internet and wireless networks. We do not guarantee that your Information will not be misused by third parties. We are not responsible for the circumvention of any privacy settings or security features. You agree that we will not have any liability for misuse, access, acquisition, deletion, or disclosure of your Information.

If you have reason to believe that your interaction with us is not secure, please contact us as described in the Contact Us section below. If you believe that your Information has been accessed or acquired by an unauthorized person, you shall promptly Contact Us so that necessary measures can quickly be taken.

We will retain your personal Information for as long as needed to provide you Services, and no longer than 24 months after the expiration of your account. We may also retain and use your Information in order to comply with our legal obligations, resolve disputes, prevent abuse, and enforce our agreements. We do our best to keep your personal Information accurate and up to date, to the extent that you provide us with the Information that we need to do that. In addition, if a School administrator, teacher, or parent desire to delete Information from their account, they must provide their username and indicate exactly which Information they desire to have deleted to us via email or facsimile. I Know It will verify this Information with the School administrator, teacher, or parent prior to deletion.

Student data is not retained any longer than necessary and/or is deleted 24 months after the expiration of your account.

If you wish to cancel your account or request that we no longer use your Information to provide you Services, or delete your Information, please contact us at helpdesk@iknowit.com. In accordance with our routine record keeping, we may delete certain records that contain Information you have submitted to us. We are under no obligation to store such Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Information.

You agree that we, our affiliates, and/or third-party service providers with whom we collaborate and contract, may communicate with you regarding our Services via electronic messages, including email, for example, send you information relating to our products and Services that we think may be of interest to you, communicate with you about contests, sweepstakes, offers, promotions, sales, specials, upcoming events, and other news about products and services provided by or through us through permissible targeted advertisements offered by us, our parent companies, our subsidiaries, and our affiliates.. A. Email. By using our Services, you agree that we may contact you by email as set forth herein. If you do not want to receive marketing and promotional emails from us, you may click on the "unsubscribe" link in the email to unsubscribe and opt-out of future marketing email communications or How to Contact Us.

B. Phone Calls and/or Facsimile. By using our Services, you agree that we may contact you by telephone and/or by facsimile at the number provided by you.

C. Mail. By using our Service, you agree that we may contact you by mail such as receiving our Welcome Packet of information when you sign up for services or products.

D. Opting Out of Direct Marketing. To exercise choices regarding the marketing information you receive, you may also review the following links:

In accordance with applicable data privacy laws, if any, and subject to certain exceptions and limitations set forth therein, we will process requests from you to know, delete and access your Information, following proper authentication and verification. To the extent a state law provides users with additional data subject rights, those rights too may be honored by the Company following proper authentication and verification.

Our Services are targeted to individuals located in the United States. Please note that in providing Services to you, your Information will be transferred to and processed within the United States. Moreover, I Know It may subcontract the processing of your data to, or otherwise share your data with, other members within the TPW family of affiliate companies, trusted service providers, and trusted business partners located in countries other than your country of residence, in accordance with applicable law. Such third parties may be engaged in, among other things, the provision of Services to you, the processing of transactions and/or the provision of support services. By providing us with your Information, you acknowledge any such transfer, storage or use.

Protecting the privacy of young children is especially important. We take special care to protect the privacy of users who are children under the age of 13. For that reason, we do not knowingly collect, use, or disclose Information from children under the age of thirteen (13) or as otherwise defined by local law without prior parental consent, except as permitted by the Children's Online Privacy Protection Act (hereinafter "COPPA") or other applicable law.

In the event we wish to collect Information from a child, we will first seek a parent or guardian's consent. With regard to School-based activities, COPPA allows teachers and School administrators to act in the stead of parents to provide consent for the collection of personal Information from children. Where a School is using our Services, we rely on the School to provide appropriate notice to parents of the School's use of third-party service providers such as I Know It, and for the School to provide consent, if necessary, and authorization for us to collect children's Information as permitted by COPPA.

Accounts on the Services may only be created by Schools and families. We do not permit children under the age of thirteen (13) to create an account. We may collect a persistent identifier (e.g., an IP address or cookie) from a child while the child is using the Services.

Some of our Services, such as educational quizzes and educational games, may seek Information necessary for a child to participate, including a parent's email address to communicate with the parent (as required by applicable law). We use and disclose children's Information only in accordance with this Policy. The Services do not enable a child to make his or her Information publicly available.

A parent or legal guardian can at any time review, request deletion of, or withdraw their consent to our further collection or use of Information collected from their child by contacting us at helpdesk@iknowit.com. Please note that we may request proof of identity and relationship to the child before doing so.

I Know It is the operator of the Services. If you have any comments or questions on policies related to children's data or about our commitment to protecting your and your children's privacy, please contact us at helpdesk@iknowit.com or by mail or telephone at the address below.

We reserve the right to make changes to this Policy and to our information gathering and dissemination practices. If we decide to change this Policy, which we may do at any time without notice to you, we will update the "Last Updated Date" and any such changes will be effective upon posting. It is your obligation to check our current Privacy Policy for any changes.
